Regulations of the Department

History of the department

The Department of Theory and History of State and Law of the Faculty of Law was founded in accordance to the decision of the Academic Council of the NAU of September 19, 2001, with the aim of providing teaching of fundamental legal disciplines and the formation of students with sound knowledge in the field of law, as well as for developing the necessary general theoretical and historical and legal base of teaching fundamental and professionally-oriented legal disciplines. Since September 2001, the department was headed by Miroshnichenko Vasyl Ivanovych, candidate of historical sciences, associate professor. From September 2003 to February 2010, the head of the department was a candidate of legal sciences, professor Vitaliy Petrovich Marchuk.Since 2010 to January 2022, the department was headed by Borodin Ivan Lukyanovich, Doctor of Law, Professor. From February 2022 to June 2022, the department was headed by Golovko Svitlana Hryhorivna, candidate of historical sciences, associate professor, veteran of NAU. Since September 2022, the head of the Department of Theory and History of the State and Law is Makeieva Olena Mykolaivna, candidate of law, associate professor.

The main tasks of the department are: ensuring the acquisition by students of a legal conceptual apparatus necessary for knowledge and mastery of legal disciplines; realization of legal education of students through subjects taught at the department; formation legal culture in students, skills and abilities of research work; organization and conducting of professional peer review practice. The Department of Theory and History of State and Law provides the teaching of 27 disciplines and conducting a professional acquaintance practice.

Since October 2017, the scientific and pedagogical staff of the department provides teaching of subjects in English for students of the 1st year of the Law Faculty within the framework of the English-language project. The main directions of the scientific-methodical and research work of the department are the problems of the theory and history of state and law and the actual problems of modern state building and legal thinking.

Lecturers of the Department of Theory and History of State and Law of the Faculty of Law take an active part in scientific-theoretical, national, and international conferences, maintain close contacts with the Institute of State and Law of the National Academy of Sciences of Ukraine. VM Koretsky, Ministry of Justice of Ukraine and its territorial divisions, the Faculty of Law of Kyiv National University. Taras Shevchenko and other higher educational institutions of Kyiv, organizations and institutions of legal direction.

The department holds round tables and theoretical and theoretical seminars on issues of protection of human and civil rights and freedoms, actual problems of state and law-making in Ukraine. It is important that, starting from the first year, students have the opportunity to participate in All-Ukrainian scientific conferences and under the guidance of experienced teachers to publish the theses of scientific research.

Teachers and employees of the Department constantly conduct educational work among the students of the faculty are mentors of student academic groups: associate professor of the department Varava I.P., associate professor of the department Rybikova A.V. associate professor of the department Oleshchenko V. Y., eading specialist Bukher M.O. Teachers of the Department organize scientific and educational excursions for students to historic preserves and museums of Kyiv, the Verkhovna Rada of Ukraine, the Constitutional Court of Ukraine, and other cognitive measures.

Professional orientation work at the department is aimed at active involvement of entrants in training at the Law Department of the NAU. Different forms of it, in particular, personal talks of faculty teachers with future entrants, interesting performances by students of the Faculty of Law about the advantages of studying at NAU help to increase the rating and competitiveness of a higher educational institution

Priority directions of scientific work:

One of the priority directions of the scientific work of the Department of Theory and History of the State and Law is working on the state budget topic "Theory and practice of ensuring human rights in the conditions of modern challenges and threats" No. 36-2022/13/01/01 (01.10.2022 - 30.06.2025), the scientific adviser of which is Makeieva O.M., PhD of Law, Associate Professor.

The aim and the purpose of the departmental research work "Theory and Practice of Ensuring Human Rights in the Conditions of Modern Challenges and Threats" is to consider and study theoretical and practical issues of ensuring human rights in the conditions of modern challenges and threats, in particular, violations of the rights and freedoms of a person and a citizen, within the limits of national and international legislation, in connection with the military aggression of the russian federation on the territory of Ukraine, violations and possibilities of restoration of human rights caused by the Covid-19 epidemic, in particular, social and economic rights, transformation of legislation to meet the modern requirements of world globalization processes.

1.The legal mechanism for ensuring law-making activity in the conditions of martial law (executor is Doctor of Juridical Science, Professor Kalyuzhny Rostyslav Andriyovych).
2. Human rights and children's rights under martial law (executor is Doctor of Philosophy Varava Iryna Pavlivna)
3. Human rights as a fundamental value of a democratic society (executor is Candidate of Juridical Science, Associate Professor Makeieva Olena Mykolaivna).
4. The Peculiarities of regulatory and legal support of the educational sector in the conditions of armed conflicts (executor is Candidate of Historical Science,Associate Professor Holovko Svitlana Grygorivna).
5. The Peculiarities of the implementation of human rights in Ukraine (executor is Candidate of Juridical Science, Associate Professor Pilgun NataliaVasylivna).
6. Human rights and armed conflicts (executor is Candidate of Historical Science, Associate Professor Cherevatiuk Victoria Bogdanivna).
7. Theoretical and practical aspects of refugee rights protection (executor is Candidate of Juridical Science, Associate Professor Rybikova Ganna Volodimiryvna).
8. Protection of human rights in conditions of martial law and threats to life and health: theoretical and practical aspects (executor is Candidate of Juridical Science, Associate Professor Suhodolska Anastasiya Andriyvna).
9. Legal foundations and problems of implementing the constitutional right to protect human rights and freedoms by the court (executor is Candidate of Historical Science, Associate Professor Suhatskiy Roman Petrovich).

The students’ studygroup "Lawyer" of the department is supervised by Candidate of Law, Associate Professor Pylhun N.V. This group carries out research work on current problems of state and law creation. The results of this work are tested in the form of thesis and reports.
