Regulations of the Department

History of the Department

The Department of Criminal Law and Procedure was created in accordance with the order of the rector of March 17, 2003 No. 37/0 as a structural unit of the Law Institute.

The department operates on the basis of the Regulation on the Department of Criminal Law and the process in accordance with the Regulation on the quality management system.

The Department of Criminal Law and Process was founded with the aim of organizing and implementing educational and educational-methodical work of criminal law disciplines, educational work among students, research in criminal law, criminal process, forensic science, criminology, training and advanced training of scientific and pedagogical workers.

In the 2003-2004 academic year, the department was headed by candidate of juridical sciences, associate professor Viktor Ivanovich Rudnik, in the 2004-2007 academic year - doctor of legal sciences, professor Kudlay Tamara Pavlovna, in the 2007-2008 academic year - K.Yu. N., associate professor Pesotskaya Natalya Nikolaevna, in the academic years 2008-2011 - Ph.D., associate professor Motlyakh Alexander Ivanovich. Since 2011, the head of the department is Doctor of Law, Professor Likhovaya Sofia Yakovlevna.

The teaching staff of the department teaches leading legal disciplines that provide fundamental legal knowledge in the field of criminal law, criminal procedural law, penal law, notaries, advocacy, prosecutors, criminalistics, basics of forensic examinations, criminal liability in the field of medicine, criminological crime prevention, combating corruption crimes and misdemeanors, methods of drafting documents in criminal proceedings.

The Department of Criminal Law and Procedure provides for the teaching of 30 academic disciplines of the educational qualification level “Bachelor” and “Master”.

The department arranges for students to practice law at the La Strada-Ukraine Public Organization, Gunsel LLC, the State Judicial Administration of Ukraine, and the Territorial Administration of the State Judicial Administration of Ukraine in Kiev in accordance with bilateral agreements.

Assistance in mastering the legal profession is provided by the teachers of the department when conducting role-playing games in academic disciplines in the Courtroom, created like real courtrooms in the courts of Ukraine.

 Semchuk Natalya – PhD, associate professor of the department;

 Rastorguyev Alexander is a senior lecturer of the department;

Maistro Diana – assistant of the department.

 


Scientific work priority directions of the Department of Criminal Law and Process:

One of the priority areas of the scientific work of the Department of Criminal Law and Process is the work on the state budget topic “Protection of the rights and freedoms of man and citizen (criminal law aspects)” from September 1, 2017, to June 30, 2022. the supervisor of studies is Doctor of Law, Professor Likhovaya S.Ya.

The Department of Criminal Law and Procedure has moved to the final stage of the state budget topic "Protection of human and civil rights and freedoms (criminal law aspects)". Researchers of the department plan to publish a collective monograph on the results of the state budget topic "Protection of human and civil rights and freedoms (criminal law aspects)" in June 2022.

Purpose of the study:
To carry out scientific research on the state of observance and realization of human and civil rights and freedoms at the present stage of development of Ukrainian statehood, criminal-legal protection of human and civil rights and freedoms in Ukraine and the world.

Main goals:
1) a study of the current regulatory framework governing the activities of law enforcement and law enforcement agencies in Ukraine;
2) an analysis of the activities of the bodies of the bar, the prosecutor's office, the notary public on its compliance with European norms and standards in the field of protection of human and civil rights and freedoms;
3) study of normative legal acts of the Council of Europe and the European Union aimed at regulating the activities of law enforcement agencies in the field of protection of human and civil rights and freedoms;
4) a comparative analysis of criminal law in the field of protection of human and civil rights and freedoms of the member states of the European Union and Ukraine;
5) preparation of materials for the assembly of works with proposals for improving the criminal law and the activities of law enforcement and enforcement agencies in order to harmonize their activities according to European standards in the protection of human and civil rights and freedoms;
6) providing suggestions and recommendations on improving the criminal law and legislation governing the functioning of the bodies of the bar, prosecutor's office, notaries in order to optimize their activities in the direction of protecting the rights and freedoms of man and citizen in accordance with European standards.

Research Methods:
When carrying out the research, a systematic approach is used, which also involves the use of other special methods of studying social and legal phenomena, such as the modeling and forecasting method, the logical-legal method, the historical-legal method, the system analysis method, and other methods of scientific knowledge.

Practical results of research work:
1) the development of issues related to the criminal law aspects of protecting the rights and freedoms of man and citizen;
2) the publication of monographs, teaching aids, textbooks and scientific articles and the preparation and publication of reports at scientific and practical conferences
3) participation in scientific and practical seminars, etc.
