Regulations of the Department

History of the Department

The Department of Criminal Law and Procedure was created in accordance with the rector's order dated March 17, 2003 No. 37/0 as a structural subdivision of the Law Institute.

The department operates on the basis of the Regulation on the Department of Criminal Law and Process in accordance with the Regulation on the Quality Management System.

The Department of Criminal Law and Process was founded with the purpose of organizing and carrying out educational and methodological work in criminal law disciplines, educational work among students, scientific research on criminal law, criminal process, criminology, criminology, training and advanced training of scientific and pedagogical workers.

Since 2011, Professor Lykhova Sofiya Yakivna has been the head of the Department of Jurisprudence.

The teaching staff of the department teaches leading legal disciplines that provide fundamental legal knowledge in the field of criminal law, criminal procedural law, criminal executive law, notary, advocacy, prosecutor's office, criminology, the basics of forensic examinations, criminal liability in the medical field, criminological prevention crimes, the method of drafting documents in criminal proceedings.

The Department of Criminal Law and Procedure provides teaching of 37 educational disciplines of the educational and qualification level «Bachelor» and «Master» in the specialty 081 «Law» of the OPP «Legal Science» and specialty 262 «Law enforcement activity» of the OPP «Law Enforcement Activity», the latter department is a graduate.

The department organizes professional practice and legal practice for students in the State Judicial Administration of Ukraine, in the territorial administration of the State Judicial Administration of Ukraine in the city of Kyiv, in the Ministry of Justice of Ukraine, in

State institution «Probation Center», in the Department for Execution of Criminal Punishments, in the Department of the Border Service of the International Airport «Kyiv» named after I. Sikorsky, in the communal enterprise «Kyiv» International Airport (Zhulyany), in the public organization «All-Ukrainian Center for Combating Corruption and assistance to law enforcement agencies «Anti-corruption initiative»» in accordance with concluded bilateral agreements.

Help in mastering the legal profession is provided by scientific and pedagogical staff of the department when conducting role-playing games on educational disciplines in the Courtroom, which is modeled after real courtrooms in the courts of Ukraine and in the educational and scientific forensic laboratory.

Priority areas of scientific work of the Department of Criminal Law and Process

 

One of the priority directions of the scientific work of the Department of Criminal Law and Process is the work on the state budget topic "Peculiarities of combating crime at the current stage of the development of Ukrainian statehood" No. 39-2022/13.01.03, term of work 01.09.2022 - 30.06.2025, supervisor Doctor of Law, professor Lykhova S.

 

The purpose and purpose of the NDR "Features of combating crime at the current stage of the development of Ukrainian statehood". The Constitution of Ukraine sets the state the task of ensuring public safety of society, proper law and order, guaranteed protection by legal means of the constitutional rights and interests of citizens, state organizations and institutions, public organizations, and all private structures. One of the factors that pose a serious threat to a developing state is crime as a relatively massive phenomenon consisting of a set of acts prescribed by criminal laws, committed in one or another territory over a certain period of time.

 

Challenges to martial law in Ukraine have given rise to a new wave of crime. Thus, the problem of countering crime began to occupy a special place in the formation of Ukrainian statehood in today's conditions, the creation of which is impossible without ensuring an active offensive counteraction to crime and achieving a slowdown in the rate of its growth on the basis of clearly defined priorities, a gradual increase in the efforts of the state and the public, improvement of legislation, organization of means and methods of crime prevention and detection.

 

Currently, there is a real need for the development of scientifically based recommendations for the adoption of new norms of the criminal material and procedural law regarding combating crime.

 

Main tasks:

 

1) research the content and main directions of modern crime prevention activities;
2) determine the current state of legal protection against crime and outline directions for its improvement in the future;
3) characterize the practice of implementation of law enforcement mechanisms to combat crime in the activities of courts and law enforcement agencies;
4) to formulate recommendations aimed at improving the theoretical and legal principles and practice of functioning of the crime prevention mechanism;
5) analyze state programming and regional planning of measures to combat crime in Ukraine;
6) research of criminological and criminal law innovations in the field of combating crime;
7) preparation of materials for a collection of works with proposals for improving criminal legislation and the activities of law enforcement and law enforcement agencies with the aim of harmonizing their activities with European standards in the field of combating crime;
8) providing proposals and recommendations on improving criminal legislation and legislation regulating the functioning of law enforcement agencies and the court in order to optimize them and bring them into line with European standards.
