March 6, 2014 PhD, lawyer, academic advisor of joint-stock company "Pravochin", Associate Professor of The Department of Civil Law and Procedure of Law Institute Roman Tytykalo participated in a joint meeting of the Committee on Civil, Family and Probate Law and the Committee of the Association of Real Estate and Construction lawyers of Ukraine. Subject: "Restructuring and acquisition of real estate assets in terms of political and economic instability".
The meeting addressed the forms and methods of structuring of the assets underlying problems of legal regulation and legal constraints in their implementation, especially the fulfillment of contractual obligations from rental property in fluctuation rate. Roman Tytykalo in his speech said that 2013 became the year of reforms in the property market since it was introduced three legislative changes: tax on housing, new rules for its evaluation and limits on cash payments of up to 150 thousand. Speaker separately focused on the liquidity of real estate, adding that after growing economic instability and political tension increased number of developers selling apartments in just small areas up to 50 square meters. the city also paid attention to the force majeure in real estate transactions, stressing that the current legislation does not define the concept of force majeure, as set forth only the concept of force majeure. Therefore, currently on the ratio of these two concepts are actively debating scientists: some see the need for demarcation of force majeure force majeure, others are sure of the identity of these concepts. Speeches ended with a lively discussion - meeting to discuss the definition of the limits of force majeure as an example of political rallies and demonstrations, in which participants in the meeting expressed their proposals on this issue.
