On April 18, 2024, Judge of the Constitutional Court of Ukraine Halyna Yurovska together with Judges Oleksandr Petryshyn and Oksana Hryshchuk held the second online lecture on "Legal positions of the Constitutional Court of Ukraine on guarantees of social protection and compensation for persons with disabilities as a result of the Chornobyl disaster".
During the online meeting, the judges focused on the key aspects of Decision No. 4-р(І)/2024 on the guaranteed level of social protection of citizens affected by the Chornobyl disaster.
The Court adopted this judgment based on the constitutional complaints of Vodolahin Serhii Mykolayovych and Volodymyr Viktorovych Nekrylov.
Judge Oleksandr Petryshyn, who was the reporting judge in this case, addressing the court, said: "The applicants challenged part 3 of Article 54 of Law No. 796 as amended, according to which in all cases the amount of a pension for disability resulting from injury or illness caused by the Chornobyl disaster cannot be lower: for disability group I - UAH 6,000; for disability group II - UAH 4,800; for disability group III - UAH 3,700; for children with disabilities - UAH 3,700." The Constitutional Court of Ukraine concluded that part 3 of Article 54 of Law No. 796 once again violated the proper level of social protection and the fundamental obligation of the state to compensate for the damage caused to persons affected by the Chornobyl disaster, which does not comply with part one of Article 3, part 2 of Article 8, Article 16, part 3 of Article 22, part 1 of Article 46, part 1 of Article 50 of the Constitution of Ukraine."
Judges Halyna Yurovska and Oksana Hryshchuk, in response, cited the legal positions set forth in a number of the Court's decisions on social protection of persons affected by the Chornobyl disaster, including the state's social obligations to citizens who lost their health as a result of the state's obligation to participate in overcoming the consequences of the Chornobyl accident and who suffered disability as a result of such actions, etc.
It should be noted that on March 28, 2024, Halyna Yurovska and Viktor Horodovenko held the first lecture on the key aspects of the CCU Decision No. 2-р(ІІ)/2024 on the guaranteed level of social protection of citizens affected by the Chornobyl disaster. Representatives of the Law Faculty of the National Aviation University also took part in the lecture.
