On October 10, 2023, Oleh Yanchuk, Director of the State Institution "Probation Center", member of the Employers' Council of the Faculty of Law, held an open lecture on the topic "New Criminal Punishment "Probation Supervision" for applicants for the first (bachelor's) and second (master's) levels of higher education of the OPP "Law Enforcement" and OPP "Law".
The topic proposed for discussion is relevant and aroused great interest among those present due to the fact that on September 27, 2023, the Law of Ukraine "On Amendments to the Criminal, Criminal Procedure Codes of Ukraine and Other Legislative Acts of Ukraine on Improving the Types of Criminal Punishments" of August 23, 2023 No. 3342-IX was officially published, which, in particular, introduces a new punishment "Probation Supervision" into the Criminal Code of Ukraine.
The purpose of the adoption of the Law is to humanize the penitentiary system and expand opportunities for the correction of a person without isolation from society. Punishment in the form of probation supervision consists in restricting the rights and freedoms of the convict, determined by law and established by a court verdict, with the use of supervisory and socio-educational measures without isolation from society.
The lecturer told for which criminal offenses this punishment will be applied and revealed the procedure for its application. It is emphasized that effective punishment is not a more severe punishment, but the awareness of offenders that they will be convicted for criminal acts and must prove to society that they have reformed.
After Mr. Oleg's speech, there was a lively discussion among those present about a new approach to the vision of the essence of criminal punishments in general, and to probation supervision in particular. The Head of the Department of Criminal Law and Procedure Sofia Lykhova noted that in connection with the adoption of the new Law, a new discipline "Modern Problems of Probation in Ukraine" has been developed and will be taught this academic year for applicants for the second (master's) level of higher education of the OPP "Law Enforcement".
Such events develop legal awareness among students of the Faculty of Law, give them up-to-date knowledge in such an area as criminal law, which is constantly evolving, especially under martial law.
