On June 19, 2023, for applicants for the second (master's) level of higher education in specialty 262 "Law Enforcement" of the PR-102Mz group (correspondence form of education), Doctor of Law, Professor, and Head of the Department of Professional and Special Disciplines of the Odessa State University of Internal Affairs Oleg Shkuta conducted a binary lesson on the topic "Specifics of the Qualification of Transport Crimes.".
"In the process of qualifying crimes against traffic safety and the operation of transport on the objective side, one should be guided by the fact that the analyzed crimes are characterized mainly by three mandatory features: a socially dangerous act; socially dangerous consequences; and the causal link between a socially dangerous act and socially dangerous consequences. Most of these corpus delicti are constructed as crimes with a material composition. This means that when qualifying crimes, it is necessary to establish the presence of not only a socially dangerous act (action or inaction), but also socially dangerous consequences and a causal link between such an act and its consequences," the scientist noted during a lesson on the discipline "Criminological prevention of offenses in the field of aviation".
As a practicing lawyer, Oleh Shkuta noted that crimes in the field of aviation are one of the most complex crimes, since the norms of the Criminal Code of Ukraine, which provide for liability for crimes in the field of aviation, have a large number of reference and blanket features.
According to the results of the lesson and the concluded cooperation agreement between NAU and ODUVS, the invited guest noted the activity of higher education students during communication, which is evidence of a high level of training, and wished students to further use the acquired knowledge and skills in future practical activities.
