On April 11, 2023, the Department of Commercial, Air and Space Law of the School of Law organized a meeting of 4th year bachelor's students with the Vice President of the Ukrainian Chamber of Commerce and Industry (CCI) Mykhailo Nepran.
While studying commercial law and commercial procedure, the students of the School of Law have repeatedly analyzed situations in which commercial legal relations were affected by unforeseen and unavoidable circumstances. Judicial practice has developed certain approaches to recognizing them as force majeure (insuperable force) and as grounds for changing an obligation, terminating it, or fully or partially exempting from economic liability in case of non-fulfillment. In addition, the procedure for certifying circumstances as force majeure by chambers of commerce and industry and the peculiarities of the relevant procedure were also of interest to the students.
The Head of the Department Liubov Netska, who moderated the online event, addressed these questions to the Vice President of the Ukrainian Chamber of Commerce and Industry Mykhailo Nepran, who, using examples from his own practice, revealed to the students the intricacies of the CCI's activities in considering applications for the recognition of force majeure and issuing certificates of certification.
The students discussed with the lecturer various types of circumstances that arose under martial law and have signs of unforeseen circumstances. Together with the participants, Mykhailo Ivanovych modeled situations complicated by force majeure or conditions that do not fall under force majeure.
During the meeting, the future lawyers improved their knowledge and skills necessary to resolve disputes related to the fulfillment of obligations affected by force majeure.
