On December 02, 2022, an online webinar "Practical issues of applying the rules of attorney ethics" was held at the Faculty of Law.
The speaker of the event was Oksana Cherniak, Assistant Judge of the Grand Chamber of the Supreme Court.
The webinar program covered such topical issues as: distinguishing between violation of the rules of advocate's ethics and the terms of the contract with the client; the possibility of recognizing an act within the framework of a civil law contract as a violation of the rules of advocate's ethics; peculiarities of the responsibility of advocates for violation of the rules of advocate's ethics.
"The Rules of Advocate's Ethics are aimed at unified consolidation of traditions and experience of the Ukrainian Bar in the field of interpretation of the rules of advocate's ethics, as well as generally accepted deontological norms and rules adopted in the international legal community", Oksana said in her speech.
Particular attention of the participants was drawn to the information about the international principles that enshrine and proclaim the role of lawyers, provide for the obligation of the state to ensure the inadmissibility of unfair and arbitrary application of disciplinary sanctions or other measures of responsibility. The moderator also dwelled on the norms of the Common Code of Conduct for Advocates of the EU countries, which Ukraine has joined and which should soon be implemented in its legislation.
The staff of the Department of Constitutional and Administrative Law expresses its gratitude to Oksana Cherniak for an interesting and informative meeting.
