On October 12-13, 2022, a judge of the Poltava District Court of the Poltava Region, a candidate for the position of a judge of the High Court for Intellectual Property (IP-Court) Stella Tsybizova held a master class for applicants for the higher education of the 2nd year of the educational degree "Bachelor" of the Faculty of Law. She told students about the civil rights and interests in court, the creation of the Supreme Court for Intellectual Property (IP-Court) in Ukraine, and the use of foreign experience of specialized judicial institutions.
The judge noted that Ukraine should take into account the international experience of the courts, as well as implement the experience of the High Court on Intellectual Property (IP-Court), in particular of the United States and European countries. One of the most successful European examples of the functioning of a specialized court in the field of intellectual property law, Stella Tsybizova considers the experience of the Federal Patent Court of Germany, which can, to a certain extent, can be adapted to Ukrainian realities.
“In Ukraine, unlike other countries, there is no experience in the work of the IP Court, a judicial institution specializing in disputes in the field of intellectual property rights. Thanks to the progressive approach of the legislator, the High Court on Intellectual Property will consider disputes on all intellectual property rights, which are granted legal protection under the legislation of Ukraine, provided that such disputes are subject to consideration according to the rules of economic legal proceedings,” the judge noted.
During the class, Stella Tsybizova also shared with the students her practical experience in handling cases in the field of civil litigation, as well as the experience she gained as a result of the international training of judges in the USA and Germany.
Summing up, the participants concluded that it is necessary to create a Supreme Court for Intellectual Property in Ukraine, as well as to further increase the level of legal awareness in the field of protection of civil rights to the results of intellectual, creative activity, and the like.
