On May 26, 2022, scientific and pedagogical workers, graduate students, and applicants for the higher education of the Faculty of Law attended an online lecture by Galyna Yurovska, judge of the Constitutional Court of Ukraine, on the topic “The right to housing under martial law”.
“Together with the National School of Judges and the Constitutional Court of Ukraine, I founded the project “A course of lectures on topical issues of today”. Today we have the seventh meeting, and my task is to acquaint you as much as possible with the legal acts, and international standards governing the issues of ensuring the right to housing, consider the practice of the European Court and introduce changes that have been made to the current legislation in connection with the introduction of martial law in Ukraine”, said Galyna while opening the event.
During the lecture, the judge analyzed Art. 30, 47, 48 of the Constitution of Ukraine, Art. 12, 25 of the Universal Declaration of Human Rights, and Art. 1 of the Housing Code of Ukraine (as amended on April 21, 2022), Art. 30 of the Law of Ukraine "On Local Self-Government in Ukraine", Art. 2 of the Law of Ukraine "On social housing reserve", Art. 11 of the Law of Ukraine "On ensuring the rights and freedoms of internally replaced persons", the decision of the ECtHR in the case "Chernenko v. Ukraine" dated January 14, 2021.
Special attention of the participants was focused on the Decrees of the Cabinet of Ministers of Ukraine, in particular: “On approval of the Procedure for the formation of housing funds for temporary residence and the Procedure for the provision and use of residential premises of housing funds for temporary residence” dated March 31, 2004 No. 422, “On approval of the procedure and conditions for the provision of subventions from the state budget to local budgets for the implementation of measures to support the territories negatively affected as a result of the armed conflict in the east of Ukraine” of October 4, 2017 No. 769, “On the collection, processing, and accounting of information on damaged and destroyed real estate as a result of hostilities, terrorist acts, sabotage caused by the military aggression of the Russian Federation” dated March 26, 2022 No. 380.
