16 травня 2022 року в рамках вивчення навчальної дисципліни «Цивільне процесуальне право України» для здобувачів вищої освіти Юридичного факультету в режимі відеоконференції проведено лекцію-диспут «Принцип гласності судочинства під час воєнного стану».
The senior lecturer of the department Iryna Slobodska revealed the peculiarities of the implementation of legal proceedings under martial law, noting that today the territorial jurisdiction of the courts has been changed, which for one reason or another cannot work during martial law. “The implementation of martial law is a good reason for resuming the procedural terms, and the courts must consider urgent cases with the written consent of all participants in the proceedings. Cases are considered remotely without the presence of participants directly in the courtroom,” Iryna noted.
The speaker pointed out that the right to bring a claim was preserved and during the war, the court formally had to accept it for consideration. However, the statement of claim must be filed in compliance with the new rules of territorial jurisdiction, and it is sufficient to send documents by e-mail in compliance with the requirements for signing documents using an EDS or using the Electronic Court subsystem.
At the end of the lecture, thanks to the YouTube channel "Judicial Power of Ukraine", students reviewed the meeting of the Economic Court of the Dnipropetrovsk region on compensation for damages for failure to fulfill obligations under a work contract.
“Judicial proceedings continue to be carried out under martial law. Judges are working, cases are being considered because even under martial law, the work of courts cannot be suspended to prevent the restriction of a person’s constitutional right to judicial protection,” Svitlana Vyshnovetska, the head of civil law and trial department, said at the end of the event.
