On May 13, 2022, the judge of the Poltava District Court of the Poltava Region, a candidate for the position of a judge of the High Court for Intellectual Property (IP-Court) Stella Tsibizova conducted an online master class on the creation and process of establishing the work of the Supreme Court for Intellectual Property (IP-Court) in Ukraine.
The judge noted that Ukraine will have to adopt the experience of the IP court of more developed countries, in particular, the United States and European countries. However, Ms. Stella considers the experience of the Federal Patent Court in Germany to be one of the most successful European examples of the functioning of a specialized court in the field of intellectual property law, which can, to a certain extent, adapt to Ukrainian realities.
“In Ukraine, unlike other countries, there is no experience of the IR Court as a judicial institution specializing in disputes in the field of intellectual property rights. Thanks to the progressive approach of the legislator, the High Court for Intellectual Property will consider disputes on all intellectual property rights, which are granted legal protection under the legislation of Ukraine, provided that such disputes are subject to consideration according to the rules of economic proceedings,” said Ms. Stella.
The judge also shared with the students her practical experience in handling cases in the field of intellectual property law and the experience gained as a result of an international internship in the USA and Germany, in particular, in considering these categories of cases by specialized intellectual property courts.
Summing up, the participants of the event concluded the need for the work of the High Court on Intellectual Property in Ukraine, as well as further raising the level of legal awareness about the protection of the results of intellectual, creative activity and fostering a culture of respect for the intellectual property rights of creators.
