On December 1, 2021, an online meeting was organized for 3rd year students of the Faculty of Law with the Head of the Investigation Department of the Obolon Police Department of the Main Directorate of the National Police in Kyiv, Lieutenant Colonel Semen Pidluzhnyak.
The lieutenant colonel of the police told the future lawyers about the peculiarities of work in law enforcement agencies, focusing on the specifics of the pre-trial investigation of criminal offenses.
"According to the Law of Ukraine" On Amendments to Certain Legislative Acts of Ukraine on Simplification of Pre-trial Investigation of Certain Categories of Criminal Offenses ", which came into force on July 1, 2020, the institute of criminal offenses was introduced in Ukraine. In accordance with Part 3 of Art. 38 of the CPC of Ukraine, during the pre-trial investigation of criminal offenses (in the form of inquiry) the powers of the pre-trial investigation body may be exercised by employees of other units of the National Police, which helps reduce the burden of investigation. Investigators investigate criminal offenses under an abbreviated procedure, the duration of which may not exceed one month from the date of service of the person of notice of suspicion. In exceptional cases, the pre-trial investigation may be extended for up to two months. It should be noted that the basis for changes in the legislation of Ukraine was the experience of police officers in foreign countries, "said Semyon Pidluzhnyak.
Summing up the meeting, the guest noted that the study of the practice of application of novelties of criminal procedural law and their scientific analysis will give additional impetus to the development of legal science, criminal law and improving the practice of its application. After all, with the development of information technology, the question of the possibility of using electronic evidence in criminal proceedings is increasingly raised, and some publications question the possibility of using artificial intelligence in the judiciary, which, in particular, will affect the criminal process.
