On October 19, 2021, Iryna Varava, a senior lecturer at the Department of Theory and History of State and Law, at the Stavyshche educational complex “General Secondary Education Institution of I-III Degrees - Law Lyceum” №2 named after O.S. Palansky Stavyshche village council of Bila Tserkva district of Kyiv region held an interactive lesson on "The right of a person to freedom from self-disclosure, the discovery of family members in the criminal process of Ukraine."
The purpose of the event - the disclosure of one of the principles of criminal proceedings, namely - freedom from self-disclosure, enshrined in Art. 18 of the Criminal Procedure Code of Ukraine.
Iryna Varava noted that in comparison with the provisions of Art. 63 of the Constitution of Ukraine, according to which a person is not responsible for refusing to testify or explain about himself, Art. 18 of the CPC specified the content and expanded the scope of guarantees of freedom from self-disclosure, noting that no person can be forced to admit guilt in committing a criminal offense or forced to give explanations, testimony that may be grounds for suspicion, accusation of committing a criminal offense.
The teacher noted that in Art. 18 of the CPC of Ukraine deals with 2 different rights of a person, namely: the right not to testify against oneself (parts 1-2 of Article 18) and the right not to testify against one's close relatives (Part 3 of Article 18 of the CPC). They can be considered both as a whole and separately, however, in essence they are different rights that should be clearly distinguished.
According to the results of the meeting, Iryna Varava noted a high level of knowledge among students in the elementary discipline "Fundamentals of Law" and interest in further raising the level of their legal awareness.
