On the 7th and 14th of November 2017, The Leavitt Institute for International Development (TLI) completed the first semester at the Educational and Scientific Law Institute, during which the American lawyer Joan Shields discussed with the future lawyers the topic "Sentencing and Appeal".
Найбільш жваву дискусію в аудиторії викликала проблема справедливої угоди між прокурором та обвинуваченим, так як при її розгляді особливо була помітна різниця між судовим процесом у США та в Україні. Джаон Шілдс пояснила студентам зміст поняття «прокурорський розсуд», а також вказала на чинники, які впливають на можливість заключення угоди між прокурором та обвинуваченим, причини поширеності такої практики та її негативні сторони.
The most lively discussion in the audience was caused by the problem of a fair deal between the prosecutor and the defendant, as it was particularly clear about the difference of the lawsuit in the United States and Ukraine. Jason Shields explained to the students the meaning of "prosecutor's discretion", and pointed to the factors that affect the possibility of concluding an agreement between the prosecutor and the defendant, the reasons for the prevalence of such practices and its negative aspects. At the end of the lesson, the students tried to simulate a trial in a criminal case. Coordinator of the English-speaking group of Scientific Society of Students and Postgraduate Students Irina Kostyana (PR-204) shared his impressions about the program "TLI". "During the classes we received a lot of useful and interesting knowledge about the legal system of USA. Particularly valuable were master classes, in which American lawyers gave us the opportunity to simulate a lawsuit and practice in the future profession. I hope this is not the last opportunity to get such experience at my university "- she said. The admiration for participating in the program was also expressed by the student of the 4th year of studying Svyatoslav Kondratchuk. The course «Critical thinking and law as a foundation for a free society has impressed me. It was an unforgettable experience that expanded my jurisprudence. It was also a good opportunity to improve English language. In addition, it was a great opportunity to get acquainted with like-minded people and get good friends "- said Svyatoslav.
